Digital Millennium Copyright Act
|
It is the policy of Invision-Graphics to respond to all notices of alleged infringement that comply with the "Digital Millennium Copyright Act," (the text of which can be found at the U.S. Copyright Office, http://lcWeb.loc.gov/copyright/. Responses may include removing or disabling access to the mentioned material claimed to be the subject of infringing activity and or terminating the subscribers or registered users account upon verification of infringement.
If Invision-Graphics Inc. removes or disable access in response to such a notice, we will make an attempt to contact the owner or author of the mentioned content so that they may file a rebuttal notification pursuant to sections 512(g)(2) and (3) of that Act. It is our policy to document all notices of alleged infringement on which we act. As with all legal notices, a copy of the notice may be sent to one or more third parties who may make it available to the public.

Infringement Notification for Copyright Material
|
To file a notice of infringement with us, you must provide a written communication (by regular mail - and not by email, except by prior agreement) that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a graphic or the content to which activity is infringing on your copyrights.
If you are not sure whether the material available online infringes on your copyright, we suggest that you first contact an attorney.
To expedite our ability to process your request, please use the following format (including section numbers):

1.) Identify in sufficient detail the copyrighted work that you believe has been infringed upon (for example, "The copyrighted graphic or graphics hosted at Invision-Graphics.com with the full URL to the source, is the same that appears on your domain http://www.your-site.com") displaying the date and copyright notice or other information sufficient to specify the copyrighted work being infringed on solely belongs to you (for example, "The copyrighted work at My Site "Digital Media," by John Doe, is published or reprinted by Digital Magazine, License #00001001101").

2.) Identify the material that you claim is infringing the copyrighted work listed in item #1 above.
Is there any of the following:
• Watermark
• Embedded Copyright
• Proof of Ownership
• Any Digital license or patent
• Any third party copyright, (example c-Site)
• Early Rough Drafts or archived media displaying date and author

3.) Provide accurate information reasonably sufficient to permit Invision-Graphics.com to contact you (by email).
Once receiving your notification by postal mail of a possible copyright infringement, Invision-Graphics will disable access to the material in question in response to such a notice until all the proper and dimmable copyright documents are submitted by the author or copyright holder.
An Invision-Graphics representative will notify the complaintiff and the defendant of the petition and start the rebuttal process to deem and credit the proper copyright holder.

4.) Provide information, if possible, sufficient to permit Invision-Graphics to notify the owner/administrator of the allegedly infringing material or content (a valid email address must be provided).

5.) You must Include the following statement in order to have your notarized letter accepted:
"I have a good faith and belief that the use of the copyrighted materials described above is allegedly infringing, is not authorized by the copyright owner, its agent, or the law."

6.) You must Include the following statement in order to have your notarized letter accepted:
"I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

7.) You must include your signature at the bottom of the notarized letter to be accepted:
Simply sign your name to the petition making it legal and bondable by law in order for us to proceed and take any action necessary.

8.) Send the written notarized document to the following address:

Please note that a copy of each "DMCA Complaint notice received," is sent to a third-party partner for witnessing and annotation. As such, your letter (with your personal information is removed) in accordance to our privacy act and tos agreement.

Rebuttal Notification
|
The accused of either graphic or content infringement may file a rebuttal notification pursuant to sections 512(g)(2) and (3) of the Digital Millennium Copyright Act. When we receive a rebuttal notification, we may reinstate the material in question until further notice or sufficient information is provided to deem the aforementioned material is being infringed upon.
To file a rebuttal notification, you must provide a written communication (by regular mail - not by email, except by prior agreement) that sets forth the items specified above. Please note that you will be liable for damages (including costs and all attorneys' fees) if you materially misrepresent that a graphic or content is not infringing the copyrights of others or you may provided proof that the mentioned work is listed in the public domain and is Licensed under the GPL/GNU.
If you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.

1.) Identify the specific URL or other unique identifying information of material that Invision-Graphics has removed or to which Invision-Graphics has disabled access to; until a resolution has been sought.

2.) Provide your real name first and last, telephone number where we may contact you for further information, valid email address, and a statement that you consent to the jurisdiction of a Federal Court in Ottawa Canada, for the judicial district in which Invision-Graphics Inc. allocated in Ontario), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

3.) You must Include the following statement in order to have your notarized rebuttal accepted:
"I swear, under penalty of perjury, in good faith that the use of the copyrighted materials described above is allegedly infringing, and is not stolen, borrowed or manipulated and I am the sole copyright owner."

4.) You must include your signature at the bottom of the notarized rebuttal to be accepted:
Simply sign your name to the petition making it legal and bondable by law in order for us to proceed and take any action necessary or tangible.

Notice of Termination
|
|
Invision-Graphics will, in all appropriate circumstances, terminate any user who infringes on any other user or individuals copyrighted material. If you believe that an account holder or registered user is a repeated infringer, please follow the instructions above to contact Invision-Graphics and provide all the information sufficient enough for us to verify that the account holder or club member is a repeated offender.
