Software Agreement
Read the following conditions carefully. By downloading Invision-Graphics software, you agree to these conditions in full. If you do not agree to the conditions, you are not entitled to download or use our software.
Invision-Graphics software is not licensed under the GNU, GPL2 open source public license, unless stated otherwise by Invision-Graphics Administrators or Staff.
The complete program package including these license conditions must be copied or transferred with all original work.
If you would like to implement modifications to individual modules in a commercial or professional environment, you should contact Mr. Shawn DesRochers by e-mail at admin@invision-graphics.com.
Agreements of this license
The objects of this agreement are those of the Invision-Graphics Divix (CMS Project) software, documentation, and license conditions.
The software provided at Invision-Graphics correspond with the current stage of technical development and deployment.
We hereby indicate that it is not possible to produce software guaranteeing error-free operations for all possible web environments.
The current version of Divix (CMS) is available exclusively at http://www.sourceforge.net for download. We offer no additional FTP services or 3rd party affiliates to transfer the software to the user's workstation.
Permission of use
The licensor (Invision-Graphics.com) provides the software user (referred to herein as the "licensee") with the simple, non-exclusive and individual right to use the software for personal purposes only on an individual domain system and in a single location (referred to herein as "license").
The licensee may install and examine the software on his or her computer.
The licensee may use the software for commercial purposes on a single domain as specified in the license agreement.
The licensee may distribute modifications to individual modules or programs licensed by Invision-Graphics - and make it accessible free of charge to third party individuals provided that the software is complete and has not been modified in any way and the attached license is distributed within the modifications.
The licensee may not sell, modify or reproduce code or modifications for profit without Invision-Graphics Inc. written consent.
The licensee may not separate the software, modules or other components in order to use them on more than one domain.
The licensee may not modify, regressively develop, decompile, or disassemble the software.
The licensee may not distribute the software on commercial domains or FTP carriers (e.g. shareware sites) without Invision-Graphics prior written authorization.
Copyrights
Invision-Graphics is copyrighted. All rights from the copyright belong to the licensor. The copyright applies in particular to the program code, and the documentation, and of the program files, the software names, any logos associated with the program and all other forms of displays used within the software.
The licensee is accorded individual and private software licenses per domain and user rights only. No software proprietary rights are accorded. The licensor retains all publication, duplication, and utilization rights for the software.
Contract
The contract is valid indefinitely and is terminated automatically - without prior notice if the licensee violates any of the conditions of this contract.
Once the contract has been terminated, the licensee must remove Invision-Graphics software on his or her computer and remove any componets of Invision-Graphics software pertaining to the software from his or her domain.
Warranty and liability
User rights for Invision-Graphics software are accorded to the licensee free of charge. The licensee accepts Divix (CMS) in the current available form. The licensee is therefore not entitled to any liability or warranty claims.
Third party rights
Redistribution and use in source and binary forms, with or without modification, are permitted provided that the following conditions are met:
1. Redistributions of source code must retain the above copyright notice, this list of conditions and the following disclaimer.
2. Redistributions in binary form must reproduce the above copyright notice, this list of conditions and the following disclaimer in the documentation and/or other materials provided with the distribution of the software.
3. Neither the name Invision-Graphics nor the names of its contributors may be used to endorse or promote products derived from this software without specific prior written permission from Invision-Graphics Inc.
THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. Final Statment of Conditions
These conditions of use are binding in their current form, as published on the website http://www.invision-graphics.com.
Any additions to this contract must be made in writing.
Canadian federal law applies to all privities of contract between the parties assigned by the court of jurisdiction in Ottawa, Ontario.
If any condition of this contract should be or become invalid or inapplicable, this will in no way affect the legal validity of the remaining license agreement and its provisions.
